Meeting was called to order at 6:20 pm by Mayor Garnett.
Welcome to everyone was conducted by Mayor Garnett
Recording of the aldermen attendance was conducted by the Mayor Pro Tem Hodges. Alderman Cope was absent.
Davis moved and Lybarger seconded a motion to approve the agenda as amended. Added Amendment 3 to new business. Motion passed 3-0.
Patron Comments: Mr. Hall presented the city with an invoice for the agreed upon engineer services for connection to Clarence Cannon Water. He also gave an update on the project schedule. Also presented was a draft resolution for the agreed project costs and services at this time. This should be adopted by the Council at the February meeting due to Attorney Ellis not being present in person. Mr. Hall also invited anyone wishing to attend the regular board meetings of Clarence Cannon which are on the 2nd Wednesday every month at 9:00am.
Mr. Robnett was in attendance regarding a building permit he had submitted. Lybarger moved and Davis seconded a motion to approve the permit. Motion passed 3-0.
Old Business:
Lybarger moved and Davis seconded a motion to approve the December 2022 minutes. Motion passed 3-0.
Hodges moved and Davis seconded a motion to approve the December 2022 monthly reports as follows: Clerk’s Report, Collector’s Report, Petty Cash Report, Treasurer’s Reports, Attorney Report; IT Director’s Report, and Public Works Reports. Motion Passed 3-0
Attorney Ellis reported that a court date has been set for 1/23/23 for the dog complaints.
Lybarger moved and Davis seconded a motion to approve the December 2022 warrant list. Motion passed 3-0.
City Clerk Position – Discussion was had. Hodges and Treasurer Parish to work on a job description and salary in preparation for posting.
New Business
Building Permit – See above in patron comments.
Repairs to city maintenance truck – a matter for the Public Works Supervisor. Recommended to proceed with estimated repairs.
Dollar General Liquor License – Hodges moved, and Davis seconded a motion to approve the liquor license. Roll Call Vote – Hodges-aye; Davis-aye; Lybarger-aye. Motion passed 3-0.
Amendment 3 discussion. After discussion an ordinance was recommended to adopt the legalization of Marijuana per amendment 3. Also, it was recommended that the issue of a 3% sales tax be put on the ballot for public vote on April 4, 2023. Motions as such were made by Davis and seconded by Lybarger. Roll call vote: Hodges-aye, Davis-aye, and Lybarger -aye. Motions passed 3-0
The ordinance was drafted by Attorney Ellis and the required 2 readings were completed.
Lybarger moved and Davis seconded to enter closed session at 7:24pm. Motion passed 3-0.
Lybarger moved and Davis seconded a motion to enter open session at 7:36pm. Motion passed 3-0.
Davis moved and Lybarger seconded a motion to adjourn meeting. Motion passed 3-0. Meeting adjourned as 7:36pm by Mayor Garnett.

Discussion was had regarding compensation of the Water Plant Operator.
Lybarger moved and Davis seconded a motion to enter open session at 7:36pm. Motion passed 3-0.
Davis moved and Lybarger seconded a motion to adjourn meeting. Motion passed 3-0. Meeting adjourned as 7:36pm by Mayor Garnett.
